How to immigrate to Canada as a refugee and asylum seeker?
How to get Canadian permanent residence as a protected person?
Following classes of people are eligible to apply under this program.
Convention Refugees and persons in need of protection determined by the Immigration and Refugee Board (IRB) of Canada
If you were found to be a convention refugee or a protected person by the Immigration and Refugee Board (IRB) you would be able to send the “protected persons and convention refugees” permanent residence application to IRCC along with your IRB notice of the decision and they will grant you permanent residence.
PROGRAM REQUIREMENTS
Current residence Outside of your country of origin/home country. If you are inside Canada, you must not be subject to a removal order. Factors You cannot return to your country due to well-founded fear of persecution based on 1) race, 2) religion, 3) political opinion, 4) nationality, or 5) membership in a particular social group such as gender, LGBTQI, etc. Decision Makers IRB for granting you refugee status, and IRCC for your permanent residence application.
Positive PRRA decisions
The Canadian Border Services Agency (CBSA) initiates your Pre-Removal Risk Assessment (PRRA) if you were found that you would not be eligible to apply for protection at IRB. Once you successfully received a “decision letter” and a “verification of status” document, then you would be able to send your permanent residence application along with these documents to IRCC for conferring you a permanent residence.
PROGRAM REQUIREMENTS
Current Residence You must be inside Canada to apply. Factors PRRA is used to make sure your country is not safe for you and to assess whether 1) you would face the danger of torture, 2) you would face the risk of persecution, 3) there would be a risk to your life, risk of cruel or unusual treatment or punishment. Decision-makers Eligibility is first assessed by a Canada Border Services Agency (CBSA) officer.
Protected Temporary Residents (PTR)
Persons who were found to be a member of the PTR class would be able to apply for PR. They should send their temporary resident permit along with the PR application for processing.
| Factors | TRP holders would be eligible to apply for PR if they are allowed to stay in Canada temporarily for protection reasons after a successful refugee protection claim, OR, they received Minister’s permit after successful refugee protection claim, source country class or country of asylum class applications. |
